Definitions:

(“User”) is the person or Legal Entity, who is consuming a product or service provisioned by RealTime7 Inc.

(“Primary account owner”) is a specific (“User”) that owns the account.

(“Regions”) are the countries, cities, and locales where the product or service is consumed (“user region”) and where the product or service is deployed (“producer region”). The country of deployment (“producer region”) is currently Ontario, Canada, the country of use (“user region”) will vary according to each user’s point of service consumption. 

Privacy Policy

We have the strictest regard for the privacy of our customers, users, suppliers, and business partners.  Data or information in any shape or form that is stored on RealTime7 Inc. servers  by valid (“Users”) is treated as privileged and confidential. It will not be disclosed, resold, leased, or licensed to third parties, except if one of the following is true:

1. The data or information is intended for public viewing in the form of Blogs, Directories, Websites, Webstores and any other tool intended to disseminate or broadcast content to the general public.
2. Contractors, who have signed appropriate non-disclosure and confidentiality agreements, and who are working with RealTime7 Inc., may use real data sampled from user accounts to test and validate product and service functionality to ensure compliance with design specifications. The Contractors must destroy all data and copies of data after the completion of their work and they do not have the right to independently disclose data obtained from RealTime7 Inc. to anyone.
3. In the event of a merger or acquisition of RealTime7 Inc. with any other party (“the buyer”), the rights and responsibilities associated with managing user data are transferred to and assumed by (“the buyer”).
4. At least one of the cases outlined in Special Cases is true

Special Cases

The laws of the (“user region”) and (“producer region”) apply in cases of investigation or dispute. The rules for individual account information disclosure under the following special cases, apply as follows:

a) case of criminal enquiry

1. law enforcement authorities have obtained a warrant, court order, subpoena, or equivalent through a recognized or acting regional government in either of  (“user region”) or (“producer region”) requesting the disclosure of user account information of an active user who is the subject of a criminal investigation.

b) case of user health emergency

1. A recognized medical authority in the (“user region”) can request the primary account owner’s information and assume the responsibility of maintaining this information for the purpose of saving the user’s life or averting bodily harm to either the primary user or other users at large.
2. Information can only be disclosed to the extent of it’s applicability to the life saving health emergency
   

c) case of civil dispute

1. Rights to the account information belong to the primary account owner.
2. If an account owner is conducting fraudulent or illegal activities that are damaging to a third party. The account owner is directly responsible to the third party for their actions. RealTime7 Inc. will not assume liability or responsibility for the alleged illicit, fraudulent, or damaging activities of a (“User”) 
3. In the event of a third party incurring damages due to the illicit, fraudulent, or illegal activity of an end (“User”), the third party should apply for an injunction or equivalent, requesting the suspension of an active account in either of the (“user region”) or (“producer region”).
4. It is the responsibility of the third party,  that is allegedly incurring damages from the illicit or illegal actions of the (“User”) to inform RealTime7 Inc. about any proceedings and request remedial action in the form of an account suspension after the successful application for an injunction.

d) In the event of death or terminal injury to a user

1. In the event of death or terminal injury to the primary account owner where a will is not present, personal information can be requested in writing and validated by a justice of the peace by the (”User’s”) next of kin.
2. If a will is present and the will mentions a primary benefactor, this primary benefactor shall assume responsibility of personal information and effects.
3. If the will specifically asks for the destruction of personal effects, the user data will be irrecoverably purged, subject to the condition that there is no court order, warrant, or subpoena in existence and filed with RealTime7 Inc. specifically preventing the destruction of personal account information in effect in either of the (“user region”) or the (“producer region”). 

Notes

In the event of legal proceedings being simultaneously initiated in more than one (“Region”), which may or may not have conflicting laws, the laws of the (“producer region”) shall hold precedence.

If any of the statements made in this document are incompatible with the laws of the (“Region”) in which any legal proceeding is initiated, the remainder of this document shall remain in effect to the fullest extent permissible under the law.

If a third party initiates legal proceedings against RealTime7 Inc., the application must be heard in the courts of the city of Brampton, Ontario, Canada.
